$160,000 settlement: A misstep leads to a ruptured Achilles tendon

The case centered around a 61-year-old woman who, after a meal at the Hot Pot Legend restaurant at the One Loudoun complex, experienced a significant fall. As she exited the restaurant, she encountered a walkway with an unusual design, one that concealed two unexpected steps within a gradual slope. To complicate matters, a decorative pillar obscured the view of these steps, making it difficult to anticipate the danger. In her confusion, the woman missed the steps and fell, resulting in an immediate and painful rupture of her left Achilles tendon. This unfortunate incident led to surgery and extensive physical therapy for the plaintiff, who had previously been an active and fit individual.

In the pursuit of justice, Attorney Thomas J. Curcio took on the case, focusing on the concept of premises liability. The core issue revolved around the absence of warning signs and contrasting colors that would have helped differentiate the walkway from the hidden steps. Additionally, the design of this particular walkway stood in stark contrast to a similar one just across the street, which featured clear markings and visible contrasts, ensuring pedestrian safety.

Claims were made against both the corporate owner of the complex and the management company, setting the stage for a legal battle aimed at holding those responsible accountable for the inadequate safety measures in place.

Ultimately, the legal proceedings concluded with a settlement of $160,000, including special damages of $70,000, covering the real costs incurred due to the accident. At times, legal cases are not just about securing financial compensation. In this instance, the One Loudoun complex will undoubtedly reconsider its safety measures to prevent similar accidents in the future.
