To complicate matters, a decorative pillar obscured the view of these steps, making it difficult to anticipate the danger. In her confusion, the woman missed the steps and fell, resulting in an immediate and painful rupture of her left Achilles tendon. This unfortunate incident led to surgery and extensive physical therapy for the plaintiff, who had previously been an active and fit individual.
In the pursuit of justice, Attorney Thomas J. Curcio took on the case, focusing on the concept of premises liability. The core issue revolved around the absence of warning signs and contrasting colors that would have helped differentiate the walkway from the hidden steps.
