What is a catastrophic injury?

Though not precisely defined, a catastrophic injury is one with long-term, serious consequences for the victim’s health, such as dismemberment, disfigurement, impairment, or disability. Examples are:

  • Brain injuries — Several types of disability or impairment can result from injuries to the brain, including those affecting hearing, vision, speech, memory, and control of bodily functions.
  • Concussion & Traumatic Brain Injuries – Almost any traumatic event can cause concussions which can lead to a traumatic brain injury. A sudden force to the head resulting in the brain moving rapidly back and forth inside your skull can damage brain cells and cause a chemical change in the brain.
  • Spinal cord and neurological injuries — The spinal cord contains nerves that transmit signals between the brain and other parts of the body. Spinal injuries can cause paralysis and loss of feeling to the legs (paraplegia) or both the arms and legs (quadriplegia). Injury to other nerves could likewise affect the parts of the body they control.
  • Dismemberment — The complete loss of limbs or other body parts may occur either in the accident itself or through amputation.
  • Organ damage — The heart, lungs, kidneys, or other organs of the body may be damaged by trauma. In exigent circumstances, organs may need to be removed, or extreme measures are taken to keep the victim alive.
  • Severe burns — Fires can cause painful and disfiguring burns to various parts of the body.

Any of these injuries can be devastating to those who must live with them. In addition to the potential financially crippling cost of past and future medical expenses and loss of income due to the inability to work, what makes an injury catastrophic is the ongoing activity restriction and reduced quality of life that the victim must endure.

Causes of catastrophic injuries

Accidents, crimes of violence, medical errors and even animal attacks can lead to catastrophic injuries. Car accidents are among the most frequent causes. Truck accidents can be particularly disastrous to passengers in passenger vehicles because of the larger size and therefore more horrific impact trucks can cause. A pedestrian or a bicycle or motorcycle rider is relatively unprotected and can consequently suffer horrendous injuries in an accident with a motor vehicle. Other causes include train accidents, slips and falls, dangerous conditions of land and buildings, and defective products.

Damages for catastrophic injuries

Because of the particularly severe nature of their injuries, successful plaintiffs in such cases can recover larger damages than usual. Not only are medical expenses more significant, but long-term therapy and enhanced health care may be required because of the nature of the injuries and the limitations they inflict on the victim’s physical activities.
