In a recent lawsuit in which a pedestrian was badly injured by a hit-and-run driver on Backlick road in Springfield Virginia, a $300,000 settlement was achieved by Attorney Rakin R. Hamad for his client.
The incident involved a 60-year-old man who was walking back to his home on the morning of the accident, when he was struck by the defendant’s car as it was making a left turn. The driver then drove away from the scene of the accident.
When the police and EMTs arrived, the pedestrian who was injured was taken to Fairfax Hospital. However, the victim was not able to give any information about himself because he did not know English and his physical condition was poor, so the initial police report had many errors. For instance, the status wrongly reported the victim’s brother as the person who had been hit, and face recognition technology was used to do this. And in the report, the victim was incorrectly placed in the road between two streets, away from the crosswalk.
The suspect was found later that evening when he was pulled over for driving without a side mirror. The next day, a passenger in his car contacted the police, detailing the incident. Armed with this new information, a detective determined the victim had been hit while walking across the street. The impact had caused him to be thrown into the road.
Unfortunately, the victim died from causes unrelated to the accident while the case was still pending. An estate representative pursued a survival claim on behalf of the victim, and Attorney Rakin Hamad secured a $300,000 settlement—an award within the insurance policy’s coverage. The ability and dedication of Attorney Rakin Hamad were key to the positive outcome for the family of the victim, in spite of the original difficulty caused by inaccurate police information.
