The number of people seriously injured or killed in automobile crashes caused by drivers using cell phones is increasing. In one such case we recently resolved, our elderly client suffered serious and permanent brain injuries when he was struck in the crosswalk by a driver on a cell phone. Another case involves an elderly woman in the crosswalk struck by a driver that was prosecuted for reckless driving, as there was evidence she was on her cell phone at the time.

The statistics reflect this alarming trend. In 2017, drivers using cell phones caused 1,587 car crashes in Virginia alone. Seven of these crashes were fatal, 587 caused injuries, and 993 collisions destroyed or caused significant property damage.

Curcio Law is an active participant and supporter of the “End Distracted Driving” (EndDD) initiative, which aims to save lives by educating, advocating, and acting to prevent distracted driving accidents. According to EndDD, distracted driving is typically caused by one or more of three main types of driving distractions:

• Manual distractions cause drivers to move their hands off of the wheel
• Visual distractions cause drivers to move their eyes away from the road
• Cognitive distractions cause drivers to lose focus and think about something other than driving

Cell phone use and texting, in particular, encompasses all three types of distractions, making it especially dangerous to do. Speaking on a cell phone increases the likelihood of having a crash by 4 times and texting while driving increases a driver’s risk of crashing by an incredible 23 times.
